By accessing or using any services provided by BILOUD SRL (VAT RO34723223), operating under the brand name LeadHosts ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our services.

These Terms apply to all visitors, users, and customers who access or use our website at leadhosts.com and any related services, including but not limited to web hosting, VPS servers, domain registration, SSL certificates, cloud storage, email services, and any other products offered through our platform.

2. Eligibility

You must be at least 18 years of age or the age of legal majority in your jurisdiction to use our services. By using our services, you represent and warrant that you meet these eligibility requirements. If you are using our services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration

To access certain features of our services, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept all risks of unauthorized access
  • Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that contain inaccurate or incomplete information.

4. Services and Pricing

We offer a range of hosting and infrastructure services as described on our website. Prices are listed in Euros (€) and are subject to change with 30 days' prior notice. All prices are exclusive of applicable taxes unless otherwise stated. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.

Service specifications, including but not limited to storage, bandwidth, and processing resources, are as described on the respective product pages at the time of purchase. We make commercially reasonable efforts to maintain the described service levels.

5. Payment Terms

Payment is due upon invoice generation. We accept major credit cards, PayPal, Apple Pay, Google Pay, and bank transfers. Failure to pay invoices within the specified period may result in service suspension. Recurring services are billed in advance according to the billing cycle selected at the time of purchase.

Late payments may incur a service suspension after a grace period of 3 days following the due date. Accounts with invoices overdue by more than 14 days may be subject to termination and data deletion.

6. Service Level Agreement

We guarantee 99.99% network uptime for our hosting services, measured on a monthly basis. Scheduled maintenance windows are excluded from uptime calculations. In the event that we fail to meet this guarantee, affected customers may request a service credit proportional to the downtime experienced. Credit requests must be submitted within 7 days of the incident.

7. Intellectual Property

All content, trademarks, and intellectual property on our website are owned by BILOUD SRL or its licensors. You retain ownership of all content you upload to our services. By using our services, you grant us a limited license to host, store, and transmit your content solely for the purpose of providing the services.

8. Limitation of Liability

To the maximum extent permitted by law, BILOUD SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services. Our total liability shall not exceed the amount paid by you for the services during the 12 months preceding the claim.

9. Termination

Either party may terminate the service agreement at any time. Upon termination, you remain responsible for any outstanding payments. We will make commercially reasonable efforts to provide you with access to your data for 30 days following termination. After this period, data may be permanently deleted.

10. Governing Law

These Terms are governed by the laws of Romania. Any disputes shall be resolved in the competent courts of Romania. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Acceptable Use Policy

1. Prohibited Activities

You may not use our services for any activity that is illegal, harmful, or violates the rights of others. Prohibited activities include, but are not limited to:

  • Hosting or distributing malware, viruses, or other malicious software
  • Sending unsolicited bulk email (spam) or operating open mail relays
  • Hosting phishing websites or engaging in identity theft
  • Distributing copyrighted material without authorization
  • Hosting content that exploits minors in any way
  • Conducting DDoS attacks or network scanning/probing
  • Cryptocurrency mining without explicit authorization
  • Operating illegal gambling or fraudulent schemes
  • Hosting content that promotes violence, hatred, or discrimination

2. Resource Usage

Shared hosting accounts must not consume resources to the extent that they negatively impact other customers. We reserve the right to throttle or suspend accounts that exceed reasonable resource usage limits. VPS and dedicated server customers are bound by the resource limits specified in their service plan.

3. Enforcement

Violations of this policy may result in a warning, service suspension, or immediate termination depending on the severity. We reserve the right to remove any content that violates this policy without prior notice. Repeated violations will result in permanent account termination without refund.

4. Reporting Abuse

If you become aware of any violation of this policy, please report it through our support portal. We investigate all reports promptly and take appropriate action.

Refund Policy

1. 30-Day Money-Back Guarantee

We offer a 30-day money-back guarantee on all new shared hosting and VPS plans. If you are not satisfied with our services within the first 30 days of your initial purchase, you may request a full refund. This guarantee applies to the hosting service fee only and does not cover domain registrations, SSL certificates, or other add-on services.

2. Refund Eligibility

Refunds are available under the following conditions:

  • Hosting Services: Full refund within 30 days of initial purchase for new accounts
  • Domain Names: Non-refundable once registered (as domain registrations are processed immediately and cannot be reversed)
  • SSL Certificates: Refundable within 7 days of purchase if the certificate has not been issued
  • Renewal Payments: Not eligible for the 30-day money-back guarantee; however, pro-rated refunds may be issued at our discretion
  • Add-on Services: Evaluated on a case-by-case basis

3. How to Request a Refund

To request a refund, please open a support ticket with the subject "Refund Request" and include your order number. Refund requests are processed within 5-10 business days. Refunds are issued to the original payment method.

4. Service Credits

In cases where a refund is not applicable, we may offer service credits at our discretion. Service credits can be applied to future purchases or renewals and are non-transferable.

5. Chargebacks

Filing a chargeback or payment dispute without first contacting our support team may result in immediate account suspension. We encourage you to reach out to us first so we can resolve any billing concerns directly.

Customer Data Policy

1. Data Ownership

You retain full ownership of all data you upload, store, or transmit through our services ("Customer Data"). We do not claim any intellectual property rights over your Customer Data. We access Customer Data only as necessary to provide the services, perform maintenance, or comply with legal obligations.

2. Data Backups

While we perform regular system-level backups for disaster recovery purposes, these backups are not guaranteed and should not be relied upon as your sole backup solution. We strongly recommend that you maintain your own independent backups of all critical data. Backup restoration requests are handled on a best-effort basis.

3. Data Location

Customer Data is stored in data centers located within the European Union unless you specifically select a different geographic region. We use enterprise-grade data centers with ISO 27001 certification, redundant power supplies, and 24/7 physical security.

4. Data Deletion

Upon account termination or service cancellation, Customer Data will be retained for 30 days to allow for data retrieval. After this grace period, data is permanently deleted from our active systems. Backup copies may persist for up to 90 days before being purged from our backup rotation.

5. Data Portability

You may export your Customer Data at any time through your control panel or by requesting assistance from our support team. We provide data in standard, machine-readable formats wherever technically feasible.

6. Law Enforcement Requests

We will only disclose Customer Data to law enforcement agencies when legally compelled to do so by a valid court order or legal process. Where permitted by law, we will notify you of any such request before disclosure. We publish a transparency report annually detailing the number and nature of law enforcement requests received.
